With Justice Janice R. Brown likely getting confirmed to the D.C. Circuit Court, the Governor's choice of her replacement on the Cal. Supreme Court promises to be an interesting affair.
I would nominate Justice Art McKinster, Fourth Dist. Court of Appeal, Div. 2. He has an excellent temperment for the job, he is a very good writer, and he has the right blend of academic knowledge and practical knowledge of the world. In the interests of fairness, I would disclose that he is my former boss, so I am biased:)
Aside from Justice McKinster, I think the Governor should look at Justices Epstein and Gilbert in the Second, and Justice Bedsworth from the 4th. If Bedsworth were to take Brown's place, the Cal. Supreme Court would have no shortage of colorful opinions.
Of course, I am operating on the assumption that the Governor is going to elevate someone from the Court of Appeal. But he could easily pull "a Carlos Moreno" and appoint someone from the federal bench or directly from the state trial court.
